Notice of collection, use, and disclosure of personal data 

                 In order to provide service and comply with the terms and conditions of the BIG POINT services (“BIG POINT Services”) as detailed in Clause 1 below. Big C Supercenter Public Company Limited (the “Company”), as the personal data controller, collects, uses and retains your data. As your data is personal data protected under the Personal Data Protection Act B.E. 2562 (the “Act”), in order to process such personal data in accordance with the requirements of the Act, the Company has prepared this document to allow you to acknowledge and understand your rights under the law, including the Company’s reason for collection, use and /or disclosure of your personal data. Please thoroughly read and understand the details for the benefit of exercising your rights.

1.    Categories of Personal Data, Period of Retention and Purpose of Collecting and Using Such Personal Data by the Company

In order for you to get the most benefits from BIG POINT Services and to allow the Company to efficiently provide BIG POINT Services to you, the Company collects, uses and retains your personal data as follows:

 1.1 Collected Data

Name-Surname, sex, age, date of birth, nationality, ID card / passport / state welfare card number, address, phone number, e-mail, Line MID, photo, purchase information, details and payment methods for goods/services, contact information between you and the Company in paper- information between you and the Company in paper-format, picture message, electronic files (images and/or audio or any other type of display output), information about application usage - Cookies as needed.

1.    To contact and provide BIG POINT Services to customers, including notification of various benefits.

2.    To identify and verify benefits and/or request to use benefits of customer.

3.    To analyse data and study customer behavior, including contact customers for opinions about Company services and products, to research, to do marketing activities, promote, develop and improve the efficiency of products and services of the Company.  

4.    To exercise legal rights and other necessarily legal proceedings related to goods and services. 

5.    To ensure safety of using services and to monitor and prevent fraud and crime or abuse of services.

2.1 Personal Data to be Disclosed

    Name-Surname, nationality, ID card/passport number, Laser ID, date of birth and phone number.

To contact and provide customers with BIG POINT Services such as point redemption and verification and/or other benefits and to do marketing activities, promote and contact customers to notify of various benefits.

Necessary to perform the obligat6ions under the contract (Terms and Conditions of BIG POINT Services) and for the legitimate interests of the Company.

USSD Service Company and SMS Service Provider.

Name-Surname, phone number, address and email.

Name-Surname, BIG POINT number, telephone number, address and ID card number

To use information to organize promotional activities and lucky draws as well as contact customers to notify of benefits and rewards/other benefits.

Necessary to perform the contract (Terms and Conditions of BIG POINT Services) and for the legitimate interests of the Company.

Data processing companies and marketing service providing companies.

2.7    Personal Data to be Disclosed

Name-surname, BIG POINT number, sex, date of birth, phone number, address, format and method of payment for products/services and purchase information.

To offer opportunities and options to purchase products and/or various types of goods.  

•    Legal Basis for the Disclosure of Personal Data

Customer’s consent

Affiliated companies, non-life insurance companies, life insurance companies, non-life insurance brokers, life insurance brokers, financial institutions, non-bank financial service companies, payment system companies, payment service companies and the Company’s business partners 

2.8    Personal Data to be Disclosed

Name-surname, BIG POINT number, sex, date of birth, phone number, e-mail, address, products payment’s method  , Purchased informations, Interested Informations and/or your personal preferences, marketing research data and your opinion as a consumer that you disclose to the Company about your experience of using the Company’s products and services and/or any other website access, applications, and/or other communication channels that the Company receives from you or our third-party data processor.

To analyze information and study customer behavior including contact customers for asking opinions about the services and products to make a marketing research to develop services and products for offers a privileges and special promotions, advertisement including news and/or products and services that appropriated for customers

3.    The right of the personal data owner

Please note that an owner of personal data is protected under the Act as described in Attachment 1.

4.    Reservation of the consent

The customer has the right, at any time, to revoke his/her consent for the collection, use or disclose of personal data of which the Company has collected, used, or disclosed upon the grant of consent thereof as specified herein and the letter of consent. Please contact the Company at a convenient channel to inform your intention, as shown in Article 5 below. Should the revocation affects any matter, the personal data protection officer will advise accordingly. The personal data protection officer may request additional document or information in case the applicant proceed on behalf of the minor, the incapable or quasi-incapable.

Attachment 1

The right of the personal data owner

The personal data owner is protected under the Personal Data Protection Act B.E.  2562 as follows:

1.    The right to revoke the consent

In the case where the Company has requested and received consent to collect, use or disclose for benefit thereof in accordance with the purpose mutually agreed by the data owner, the data owner has the right to revoke his/her consent on the use of such personal data at any time. 

2.    The right to access and receive a copy of personal data stored by the Company

The data owner has the right to access and receive a copy of his/her data stored by the Company under the criteria set forth by the Personal Data Protection Officer.

3.    The right of request for disclosing the procurement of personal data from an alternative source.

In the case where the Company has received personal data from any source other than directly from the owner of the data, the Company will inform the owner within 30 days after the date receiving such personal information (unless it is required by law). In such a case, the data owner may inquire and request the Company for disclosure of the source of such personal data.

4.    The right to receive and request the Company to transfer or forward the data to other personal data controller when the Company adjusts the format of the data storage for automated reading and transfer

The transfer or forward of personal data hereunder shall include the case when personal data is stored in electronic format. The transfer proceeds via an electronic device that can read electronic data only, not include the courier's data transfer, or deliver personal data in other formats. 

5.    The owner's right to object to the collection and use of personal data

The owner has the right to object to the collection and use of his/her data under the following circumstances:  

(1)    The collection of personal data can proceed without consent as permitted by the bylaws or other juristic person other than personal data controller (unless such benefit is below basic right of the data owner or;

(2)    the collection, use, or disclosure of personal data is for direct marketing; 

6.    The right to request to destroy or turn personal data given to the Company into unanimous data.

The data owner may make a request to the Company for the elimination of his/her own personal data and/or turn his/her given data into unanimous data under the following circumstances:

(1)    The personal data is no longer necessary for the storage of personal data according to the objectives.

(2)    When the data owner revokes his/her consent in collecting, using, or disclosing personal data, the Company shall have no legal authority to collect, use, or disclose such data.

(3)    When the data owner exercise his/her right to oppose the collection, use, or disclosure of personal data, the Company shall not reject such request or;

(4)    When personal data is collected, used, or disclosed illegally,

7.    The right of request to the Company for suspension of personal data 

The data owner may inform the Company to suspend the use of his/her data immediately under the following circumstances:

(1)    When the personal data controller is under the examination of accuracy, completeness, or update such data as per the data owner's request.

(2)    When such personal data could be deleted or destroyed, the data owner may request to suspend such data instead of deletion or destruction.

(3)    When such personal data is no longer necessary for storage under the purpose of data collection but the data owner requests to continue the storage for initiation of right permitted by law, compliance or exercise of a legal right or to raise as a right of a claim as permitted by law.

(4)    When the Company is considering the exercise of data owner's right against the collection, use, or disclosure of personal data  

8.    The right to request the Company to correct, validate and update personal data 

In case of any changes regarding personal data given to the Company or that the Company has collected, the data owner may request the Company for any correction or update at any time.

9.    The right of claim in case it is found offensive against Personal Data Protection Act B.E. 2562 

In case the data owner finds that the Company and/or employee of the Company conduct any action that violates or contravene the Personal Data Protection Act B.E. 2562, the data owner may report such violation to the Company and/or relevant authority as detailed in Article 4 of this document.

Please note that when the Company receives notice of the wish to exercise any rights from the data owner, the Company will consider such request to proceed with proper action within 30 days from the date of receipt. The Company reserves the right to reject such request from the data owner where it is contravene to the law or necessary and legal right to refuse.


 

Terms and Conditions and Notification on the processing of Personal Data for BIG POINT Membership

1. About BIG POINT

Customers ("Customers") of Big C Supercenter Public Company Limited (hereinafter referred to as the "Company"), please be informed that the Company has established a program for collecting points from purchasing goods. The accumulated points can be redeemed for discounts/benefits in accordance with the terms and conditions specified in the program. Furthermore, the Company shall provide and offer products and services, promotional items, and benefits from the Company, affiliates or subsidiaries to the members of its loyalty program ("BIG POINT"). Customers can apply to join the program by subscribing for BIG POINT membership in accordance with the conditions, methods and procedures as detailed below:

By applying for BIG POINT membership, you agree to comply with BIG POINT's terms and conditions, including those regarding earning points, point redemption, services and permission to use your personal data. Therefore, please read the relevant terms and conditions thoroughly before applying for BIG POINT membership. Once you agree to become a BIG POINT Member, the Company will assume that you have thoroughly read, understood, and agreed to abide by the relevant terms and conditions in all respects.

2. BIG POINT Membership Application Process

2.1 A customer who wishes to apply for BIG POINT membership (the "BIG POINT Applicant''), whether of Thai or any other nationality, agrees to allow the Company to access, collect and use the Personal data of the BIG POINT Applicant which is recorded and stored in the ID card, Smart Card, or passport or any other document issued by a government agency and/or collected by the Company from other sources or persons in accordance with current applicable law. In addition, the BIG POINT Applicant agrees to duly and correctly fill out all important information.

2.2 After filling out the form and all the required information and reading and understanding the BIG POINT membership conditions, ways of earning points, and redemption methods, as well as the terms and conditions of service and consent to use the personal data of BIG POINT Members, the BIG POINT Applicant shall confirm acceptance of the BIG POINT membership conditions as follows:

2.2.1 If a BIG POINT Applicant applies for his/her membership via any channel of the Company, the BIG POINT Applicant will receive an OTP code (One-Time Password) or a passcode via the mobile phone number provided. After receiving the OTP or passcode, the BIG POINT Applicant must use such OTP or passcode to complete the transaction as shown on the screen. The BIG POINT Applicant shall verify his/her identity before using his/her BIG POINT membership for the first time.

2.2.2 In the case of applying via a documentation channel or a device that can be signed, the BIG POINT Applicant must affix his/her actual signature to such document or device.

2.2.3 In the case of applying at a Big C branch, the BIG POINT Applicant is required to insert his/her ID card for verification. For applying through other channels, the BIG POINT Applicant must correctly fill in the details according to his/her ID card to verify the first validation.  

3. Terms and Conditions of BIG POINT Membership

General conditions

3.1 The terms and conditions of BIG POINT membership, earning points, and redemption, and the terms for using the services, and the permission to use the personal data of BIG POINT members (hereinafter referred to as the "BIG POINT Terms and Conditions") are considered an agreement between the BIG Member subscriber (hereinafter referred to as "BIG POINT Member" or "You") and Big C Supercenter Public Company Limited (hereinafter referred to as the "Company"). BIG POINT Members agree to join the program and agree to be bound by the terms and conditions determined by the Company for being a BIG POINT Member.

3.2 BIG POINT Members agree to, accept and are bound by the BIG POINT Terms and Conditions as specified by the Company at the time of subscription and any future amendment thereof. BIG POINT Members also agree to allow the Company to change the conditions for the exercise of membership privileges, rewards, gifts to be redeemed and various privileges and benefits without prior notice. 

3.3 BIG POINT membership can be lifelong (no membership expiry period). You can check your reward points on your Big C receipt, the Big C TH application, the website https://bigpoint.bigc.co.th/en/customer/account/login and the Line  application “Big C”.

3.4 BIG POINT Members acknowledge that the Company has a duty to provide services to You as a BIG POINT Member, and You have the right to receive the following services from the Company:

3.4.1. Earning BIG POINT Member points according to the conditions for earning BIG POINTs;

3.4.2 Redemption of existing BIG POINTs according to the conditions for BIG POINT redemption;

3.4.3 Receiving notifications and presentations of products and services that are on sale in Big C and Mini Big C stores, as well as sales promotions (including the right to participate in activities, sales booths, privileges and promotions, discounts, special offers, advertisements and notifications) and benefits related to the products and services that are available in Big C and Mini Big C stores; the aforementioned also applies to products and/or services of the Company's affiliates and/or subsidiaries and/or business partners which the Company deems to be beneficial to BIG POINT Members, of which BIG POINT Members will be informed via communication channels that BIG POINT Members have provided to the Company, including an online channel, email and SMS; and

3.4.4 Receiving any other services that the Company has specified, or offers with additional terms and conditions which may be adjusted as appropriate from time to time. 

3.5 In order for the Company to provide the services according to Article 4) to BIG POINT Members, You agree and give consent that the Company may use the information You have provided in the application for BIG POINT membership, including the information that is subject to change hereafter; You also agree that the Company may use your information that the Company has collected or processed from your purchasing products from and/or using any services of the Company through Big C branches and/or Mini Big C stores or via online applications or call center to send news to mobile phones, emails, addresses, and other channels for which you have given consent to the Company and/or our representatives to offer promotional services and marketing. In case of dispute, you accept that the Company's decision is final.

3.6 BIG POINT Members agree and accept that the Company may perform the services as described in Article 4) by itself, or it may hire a third party to perform such services.

3.7 BIG POINT Members can change or cancel the information that is received from the Company by contacting the Call Center on 1756, or using the online system on the Company's website with their BIG POINT Member account. Data and personal data of BIG POINT Members will be kept confidential and will not be disclosed to any unauthorized party. The Company reserves the right to not be responsible for any damage resulting from BIG POINT Members logging in to their account.

3.8 BIG POINT Members agree and accept that the Company has the right to reject or cancel the rights of BIG POINT Members without specifying the cause of such rejection or cancellation, or without giving prior notice, under any circumstances.

3.9 The Company reserves the right to approve only one BIG POINT membership for every ID card number / passport number / mobile number. The BIG POINT Member must be at least 10 years of age and must not be an incompetent or a quasi-incompetent person.

3.10 BIG POINT Members accept and agree that all personal data and all information used in this application is true, accurate and correct, and the Company has the right to revoke the rights of BIG POINT Members in case it is found that such information is not true.

3.11 The Company reserves the right to make any changes to the BIG POINT Terms and Conditions from time to time without prior notice. BIG POINT Members are requested to follow the news and notifications regarding updates and amendments of the BIG POINT Terms and Conditions as notified by the Company from time to time in order for BIG POINT Members to clearly and completely understand the rights and conditions for the receipt of various services of the Company.

4. Conditions for earning points from payment for goods and/or services

4.1 BIG POINT Members agree and accept that to earn points, their BIG POINT membership must be presented at the service point designated by the Company only.

4.2 BIG POINT Members agree and accept that the earning of points from payment for goods and/or services shall be in accordance with the list of promotions for each product as specified by the Company and/or the Company's marketing policy.

4.3 BIG POINT Members agree and accept that the benefits offered to each BIG POINT Member may differ depending on the purchase history of each member, list of individual product promotions and/or the Company's marketing policies applicable at that time.

4.4 The period for accumulating BIG POINT is determined by company. Read more at

4.5 Please note that BIG POINT Members cannot request the Company to transfer their points across membership numbers, and reward points cannot be exchanged/redeemed for cash. 5.  Conditions for point redemption or receipt of benefits

5.1 BIG POINT Members agree and accept that they are required to show ownership of their points at every redemption. The benefit from point redemption must be used by the same BIG POINT Member number only.

5.2 The Company reserves the right to amend the rewards points in case it is established that the points available for redemption do not match the actual purchase of products/services; the Company also reserves the right to change the conditions of redemption and/or items of goods or services and/or points used for each product or service as well as to cancel the exchange for free products or services and/or various benefits as the Company deems appropriate without prior notice to BIG POINT Members. 6. Returning products and/or accumulated points

6.1    When returning purchased products, BIG POINT Members agree that they must return the points earned from the purchase of the returned item and the reward/discount redeemed from the previously spent points to the Company. In the case where the reward cannot be returned in good condition, BIG POINT Members agree to refund the cash instead.

6.2 When BIG POINT Members use points accumulated on their BIG POINT to earn a discount when purchasing products in Big C or Mini Big C stores as specified by the Company, and the purchase of any items is cancelled, BIG POINT Members accept that the points used to earn a discount will not be returned to them without exception.

7. Terms for the acceptance of services and authorization of personal data use 

These terms for the acceptance of services and authorization of personal data use by the BIG POINT Members are an integral part of the BIG POINT Terms and Conditions. Please read and study the terms for the acceptance of services and authorization of personal data use carefully in order to understand the terms and guidelines of the Company regarding the management and protection of personal data of BIG POINT Members.

7.1 Collection of personal data of BIG POINT Members

BIG POINT Members acknowledge that in order for the Company to provide services and benefits to BIG POINT Members, the Company will collect their personal data by direct communication through various channels such as when You fill out your information in an application form, contract, letter or other document, or via electronic systems such as when You fill out your information via the website or applications of the Company or via other channels such as a telephone system that can record audio.

For communication between BIG POINT Members and the Company through various channels, i.e., telephone, e-mail, Company applications, the customer service center (call center) or any other contact channel, the Company may record such communication for various purposes. Examples are to serve as evidence of communication, to develop and improve service, to monitor user satisfaction, to train personnel, to analyze the data, and to develop the service system of the Company.

In this regard, when collecting your personal data, the Company will collect only the personal data that is necessary for the lawful purposes which were informed to You prior to or during the collection of such personal data.

In the event that a BIG POINT Member has provided the Company with any personal data of a third party, such as providing the third party's full name and telephone number as an emergency contact, the BIG POINT Member shall ensure that he/she has informed such third party about the disclosure and the collection of such personal data by the Company, and that the said third party has given the BIG POINT Member his/her consent to disclose his/her personal data to the Company, to enable the Company to collect, use and disclose such information in accordance with the Company's terms and conditions of service.

7.2 The use of cookies to collect information

A cookie is a file format that contains text. It is created when a user visits a website on a server, and it is saved in the browser when the user visits that website. The content of the cookie can only be retrieved, viewed or read by the server that created the cookie. Also, the content will be sent back to the website from the start of each visit. The text contained in cookies often includes identifiers, website names, and certain numbers and letters. Cookies will store details of the website user's browsing behavior and what is frequently chosen by the user and the user’s browser. If you visit the Company's website, the Company may collect your information through cookies. 

This website may contain links to other websites. If you click on a link to another website, it may permit a third party to collect and disclose your information. The Company has no control over other websites and is not responsible for the privacy disclaimer of such websites. When you leave the Company’s website, we recommend that you read the privacy notice of every website that you visit.

7.3 Categories of Personal data, Storage Time, Purpose of Collection, Use and Disclosure of Personal data by the Company

We collect and use your personal data for the benefit of providing BIG POINT services to you. The Company has provided a written notice which describes details of the collection, use and disclosure of personal data of BIG POINT Members as can be found   https://bigpoint.bigc.co.th/en/terms-and-conditions 

7.4 In which circumstances does the Company disclose your personal data

The Company will keep your personal data confidential without disclosing it to third parties or the public unless for the purposes notified as shown in [Notice of personal data collection, use and disclosure], or unless the Company has obtained your explicit consent or has a legitimate cause for disclosure.  

7.5 Using your information for marketing purposes

The Company may use your personal data to offer you products or services that may benefit you and may contact you from time to time to notify you about new or existing products or services. In addition, the Company may disclose your personal data to our affiliates or business partners to enable them to inform you of products or services through various marketing channels, by electronic correspondence, e-mail, telephone calls, messages and other forms of communication only to the extent possible in order to fulfill our obligations to provide you with the BIG POINT services in accordance with the terms and conditions of use and/or only to the extent that you have given your consent.

If you wish to change any method of contact that you have notified to the Company, or if you no longer wish to receive any of the above marketing communications, you may notify the Company at any time via the Call Center on 1756, or online via the website at https://bigpoint.bigc.co.th/en/customer/account/login or the Big C application, or notify your wishes at any branch of Big C. 

In addition, please be informed that in the case that you cancel the receipt of information from the Company, it may cause you to lose certain rights in relation to the offered benefits and promotions on products and services from the Company. In such an event, the Company reserves the right to provide services and benefits of BIG POINT only for the services for which you did not cancel the receipt of such information.

7.6 Transfer of personal data to other countries

In the business operations of the Company, the Company will not transfer or disclose your personal data to overseas recipients except in the case of disclosure of your personal data for the purpose notified to You, or when the Company has obtained your explicit consent or has a legitimate reason for such disclosure.

As a parent or legal guardian, please do not allow a minor under your supervision to provide the Company with his/her personal data without your consent. If a BIG POINT Member continues to use services or purchase of products or contact with the Company or continue to have any relationship with the Company as a customer and/or a BIG POINT Member after the Company has amended this BIG POINT Terms and Conditions, it shall be deemed that the BIG POINT Member has acknowledged and agreed to be bound by and comply with such amended terms.
